Welcome to ecomap (accessible at https://ecomap.ngo, hereinafter referred to as the "Platform"), operated by "Ecoparsec" NGO ("we", "us", or "our").

By accessing, browsing, registering an account, or using the Platform, you ("User") agree to be bound by these Terms of Use ("Terms"). If you do not agree with any part of these Terms, you must refrain from using the Platform.

1. General Provisions

1.1. Scope: These Terms govern your access to and use of the Platform, including any mapping data, services, interactive layers, and user-generated content.
1.2. Applicable Law: These Terms and any disputes arising out of or related to the use of the Platform shall be governed by and construed in accordance with the laws of the Republic of Armenia.
1.3. Privacy: Your use of the Platform is also governed by our Privacy Policy and Cookie Policy, which form an integral part of these Terms.

2. Account Registration and Security

2.1. Account Creation: Certain features (such as adding markers, editing layer attributes, or uploading media) require creating an account. You agree to provide accurate and current information during registration.
2.2. Account Responsibility: You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
2.3. Termination: We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, if you violate these Terms or engage in fraudulent, harmful, or illegal behavior.

3. User Content and Mapping Data (UGC)

3.1. User Submissions: Users may contribute geographic data, photos, text descriptions, and other content ("User Content").
3.2. Ownership & License: You retain ownership of your User Content. However, by submitting content to the Platform, you grant "Ecoparsec" NGO a worldwide, non-exclusive, royalty-free, perpetual, transferable, and sublicensable license to use, display, reproduce, modify, adapt, and distribute your User Content in connection with the Platform's operation, media publishing, and open data initiatives.
3.3. User Guarantees: You represent and warrant that you own or have the necessary rights, licenses, and permissions to submit the User Content and that your content does not violate any third-party intellectual property or privacy rights.
3.4. Open Data Principles: Mapping data submitted to the Platform may be published under open data framework principles (such as CC BY 4.0 or Open Database Licenses) for civic and environmental research purposes.

4. Acceptable Use and Moderation

4.1. Prohibited Activities: You agree not to:

• Submit false, misleading, defamatory, offensive, or illegal data or markers.
• Use automated systems (crawlers, bots, scrapers) to extract data from the Platform without prior written consent.
• Attempt to disrupt, overload, or compromise the technical infrastructure or security of the Platform.
• Reverse-engineer, decompile, or attempt to derive the source code of the underlying software.

4.2. Moderation Rights: We reserve the right, but are not obligated, to review, edit, reject, or remove any User Content at any time and for any reason without prior notice.

5. Intellectual Property

5.1. Platform Ownership: All proprietary code, software, core mapping interfaces, platform branding, logos, design elements, and compiled open datasets remain the intellectual property of "Ecoparsec" NGO or its licensors.
5.2. Limited License: Subject to these Terms, you are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial, or educational/civic research purposes.

6. Disclaimers and Limitation of Liability

6.1. "As Is" Basis: The Platform and all information contained therein are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding accuracy, reliability, completeness, or uninterrupted availability of the map layers or user submissions.
6.2. Limitation of Liability: "Ecoparsec" NGO, its officers, employees, and partners shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your access to, use of, or inability to use the Platform, or any reliance on user-submitted data.

7. Dispute Resolution

7.1. Pre-Trial Settlement: In the event of any claim or dispute, the User agrees to first attempt an informal resolution by sending a written notice describing the issue to [email protected].
7.2. Response Time: We will endeavor to address and resolve the claim within 30 days of receipt before any party initiates formal legal proceedings.

8. Changes to Terms

8.1. We reserve the right to modify these Terms at any time. Updated versions will be posted on this page with a revised "Last Updated" date. Continued use of the Platform after changes take effect constitutes acceptance of the new Terms.
